Sandpoint Realty LLC respects copyright. If you own copyright in material that appears on sandpointrealtyidaho.com and you believe it was posted without authorization, this page tells you how to have it removed.

This procedure is governed by the Digital Millennium Copyright Act, 17 U.S.C. § 512.

How to file a notice of infringement

Send your notice to the agent above. To be effective under the DMCA, your written notice must include all of the following:

1. A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf.
2. Identification of the copyrighted work you claim has been infringed. If multiple works are covered by one notice, a representative list.
3. Identification of the material you claim is infringing, with enough detail for us to locate it. The full page address and a description of the specific photo, text, or file is the fastest way.
4. Your contact information: name, mailing address, telephone number, and email address.
5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in your notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

What we do when we receive a notice

1. We review it for the required elements.
2. If it is complete, we remove or disable access to the material, usually promptly.
3. We make a reasonable effort to notify whoever posted it, and forward them a copy of the notice.
4. If we receive a valid counter notice, we follow the process below.

Counter notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter notice to the agent above. It must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and the location where it appeared before removal.
3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
4. Your name, address, and telephone number.
5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which Sandpoint Realty LLC may be found, and that you will accept service of process from the person who filed the original notice or their agent.

If we receive a valid counter notice, we may restore the material in 10 to 14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the activity.

Repeat infringers

We will terminate, in appropriate circumstances, the access or account of anyone who is a repeat infringer.

A note about listing photos

If your complaint involves original photography, video, or blog writing produced by Sandpoint Realty LLC, that material is ours and is not licensed for reuse without written permission. See our Terms of Use.
